Keeping busy

      The Clean Water Act of 1972 was designed to do more than control pollution discharges by industry, etc.  It also established the means to control pollution and protect wetlands from activities of mankind that would degrade our surface waters, such as the discharge of dredged or fill material resulting from dam construction, stream re-channelization and other such activities.  The U.S. Corps of Engineers is the permitting agency for these activities.  The permit applications are made public by the Corps at various times, and as with the NPDES permits and others, there is a public comment period.  After the close of the comment period the Corps takes the comments made into consideration as it decides whether to issue the permit as submitted, modify certain requirements or call for additional requirements before the permit is granted, or not grant the permit at all.  Most permits are granted in one form or another and often modified at a later date.  Some are even posted and granted after the activity has been completed.   When a permit application affecting the Arkansas River Basin is made public and we receive notice, we will post the notices here.  Directions for posting comments are within each notice.

A Draft Great Plains Regional supplement to the 1987 Wetland Delineation Manual is now available.

The supplement is being peer reviewed as well as field tested to "assess its clarity and ease of use, and to determine whether use of the supplement will result in an spatial changes in wetland jurisdiction for Clean Water Act Section 404 purposes."

The notice states that the Corps is specifically seeking public input.

Public Notice regarding issuance of a Regulatory Guidance Letter (RGL) covering minimum requirements for monitoring compensatory mitigation projects that involve the creation, restoration or enhancement of aquatic resources.

Specifically the RGL requires that mitigation sites be monitored for a minimum of five years and shall include annual monitoring reports of no more than 10 pages in length.

Various studies indicated that the USACOE "was not providing adequate oversight to ensure that compensatory mitigation projects were successfully replacing the aquatic resource functions and services lost as a result of permitted activities." A proposed Mitigation Rule and this RGL are an attempt to see that mitigation is accomplished and leads to the goal of no net loss of wetland resources.
